释义	法律分析：对土地公有制之前，通过购买房屋方式使用私有的土地，土地转为国有后迄今仍继续使用的，未经确权登记，亦应确定现使用者的国有土地使用权。国有土地上房屋征收补偿中，应将当事人合法享有国有土地使用权的院落、空地面积纳入评估范围，按照征收时的房地产市场价格，一并予以征收补偿。法律依据：《中华人民共和国拆迁法》第二条为了公共利益的需要，对国有土地上单位、个人的房屋实行征收以及对被征收房屋的所有权人(以下简称被征收人)给予补偿的，适用本条例。
