释义	对胎儿保留份额的处理，依胎儿出生时是死体还是活体而不同：(1)如果胎儿出生时是活体的，则该保留份额为该婴儿所有，可由其母亲代为保管。(2)如果胎儿出生后不久即死亡，则该保留份额为该婴儿所有，但应由，该死婴的法定继承人按法定继承处理。(3)如果胎儿出生时即为死胎，则该保留的份额由被继承人的继承人再分割。《民法典》第一千一百五十五条，遗产分割时，应当保留胎儿的继承份额。胎儿娩出时是死体的，保留的份额按照法定继承办理。法律依据: 《中华人民共和国民法典》第一千一百五十五条。
