释义	法律分析：保证金留存或提存的时间和数额是没有限制的。双方当事人可以自行约定在合同履行前、合同履行过程中皆可；保证金的数额可以相当于债务额，并不像定金那样，其总额不得超过主合同总价款的20%，而且必须是在合同约定时或者合同签订前给付。法律依据：《最高人民法院关于适用中华人民共和国担保法若干问题的解释》第一百一十八条定当事人交付留置金、担保金、保证金、订约金、押金或者订金等，但没有约定定金性质的，当事人主张定金权利的，人民法院不予支持。
