释义	法律主观：房产证是房屋产权的法定凭证，土使用证在地产交易与房产交易中的作用是不同的。房产交易中最好当然是二证齐全，但房屋产权中的土地使用证常常因为各种原因而不能办理，其中历史的原因是主要的。除开发商因土地手续问题之外，其他房产没有土地使用证的一般都不影响房屋产权，也不影响房产交易和拆迁补偿。房改房没有土地使用证基本是历史原因造成的，交易中也难以补办，并不影响房屋产权的所有功能。如果可以补办，要卖主先行补办，然后才能过户给你，你要缴纳一笔土地出让金(划拨土地必须要交的)。
