释义	成约定金，即为合同成立要件的定金，与要物合同之物的交付，作用相同。司法解释第116条规定，当事人约定以交付定金作为主合同成立或者生效要件的，给付定金的一方未付定金，但主合同已经履行或履行主要部分的，不影响主合同成立或生效。法律依据：《担保法司法解释全文》第一百一十六条当事人约定以交付定金作为主合同成立或者生效要件的，给付定金的一方未支付定金，但主合同已经履行或者已经履行主要部分的，不影响主合同的成立或者生效。
