释义	法律分析：继父母视为拟制血亲，从法律上取得了血亲的身份，进而取得抚养权。法律侧重于对子女的保护。出于保护子女权益和身心健康的目的，法律无明文禁止继父母对继子女行使抚养权。但是抚养权最根本是建立在血亲上，姻亲关系，即使时拟制血亲，在现行法中亦不能对抗血亲形成的抚养权，故继父母抚养权的主张不能对抗生父母。法律依据：《中华人民共和国民法典》第一千零七十二条继父母与继子女间，不得虐待或者歧视。继父或者继母和受其抚养教育的继子女间的权利义务关系，适用本法关于父母子女关系的规定。
