释义	精神病人订立的遗嘱一般情况下是无效的，因为遗嘱人订立遗嘱时必须头脑清醒，能够分辨自己的行为，具有民事行为能力。如果遗嘱人在订立遗嘱时，有医院或相关鉴定机构出具的民事行为能力鉴定书的，一般亦认定遗嘱人具有遗嘱能力。【法律依据】《民法典》第一千一百四十三条规定，无民事行为能力人或者限制民事行为能力人所立的遗嘱无效。遗嘱必须表示遗嘱人的真实意思，受欺诈、胁迫所立的遗嘱无效。伪造的遗嘱无效。遗嘱被篡改的，篡改的内容无效。
