释义	法律分析：没签正式合同能否退定金，有以下三种情况： (1)如果交了定金双方就合同内容协商了但不能达成一致而导致合同未能订立的，不适用定金罚则。 (2)一方无故不在约定期限进行协商或擅自改变认购书中的内容而导致买卖合同未能订立的，适用定金罚则。 (3)因不可抗力、意外事件、政策调整致使一方有正当理由的，不适用定金罚则。法律依据：《中华人民共和国民法典》第五百八十六条当事人可以约定一方向对方给付定金作为债权的担保。定金合同自实际交付定金时成立。
