释义	法律分析：诺成合同自双方当事人意思表示一致时起合同即告成立，当事人未交付标的物或完成其他给付的，产生违约责任。实践合同在当事人交付标的物时，合同才能成立；交付标的物或完成其他给付是先合同义务，不产生违约责任，但可能构成缔约过失责任。法律依据：《中华人民共和国民法典》第四百六十四条合同是民事主体之间设立、变更、终止民事法律关系的协议。婚姻、收养、监护等有关身份关系的协议，适用有关该身份关系的法律规定；没有规定的，可以根据其性质参照适用本编规定。
