如何完善网络电子证据保全 |

一、办理电子证据保全公证注意事项在电子邮件(E—MAIL)证据保全公证中，我们必须要掌握电子在邮件(E—MAIL)关键性要素。①应对电子邮件(E—MAIL)特征，采取科学的保全措施，明确保全的证据种类，清楚保全事项。②说明证据保全的过程，说明证据保全是什么时间开始、结束，着重点是讲究顺序的连续性和关联性。③应明确证据保全是在什么地点进行的，这能够说明公证是否有管辖权。《民事诉讼法》第29条规定，侵权行为的诉讼由侵权行为发生地的法院管辖。④根据保全采取什么样的上网方式，具体使用什么电子邮件收发程序，实时下载打印的内容，保全的数据。⑤确定公证申请人，侵权人的身份和可靠性，告知证据保全主体的合法性。⑥告知保全证据如何处理，经保全的证据光盘交有关申请当事人和公证处封存。二、完善网络电子证据保全①《民事诉讼法》第67条规定，经过法定程序公证的法律行为，法律事实和文书，人民法院应当作为认定事实的根据。但有相反证据足以推翻公证证明的除外。②《公证法》第36条规定，经公证的民事法律行为、有法律意义的事实和文书，应当作为认定事实的根据，但有相反证据足以推翻该项公证的除外。在我国只有人民法院和公证机构采有证据保全的权力;(最高人民法院关于适用《中华人民共和国民事诉讼法》若干问题的意见)第75条规定，“已为有效公证书所证明的事实，当事人无需举证”;《最高人民法院关于民事诉讼证据的若干规定》第77条规定：“人民法院就数个证据对同一事实的证明力，可以依照下列原则认定，“①……，②经过公证、登记的书证，其证明力一般大于其他书证、视听资料和证人证言。
