释义	法律分析：外国人只要达到中国的法定退休年龄，其正在与公司履行的劳动合同依法终止。在达到中国法定退休年龄之后订立劳动合同，即使外国人已经依法办理了工作许可和居留许可，双方仍不能形成劳动关系，不能适用中国劳动合同法。公司据此可以合法解除达到法定退休年龄外国人订立的“劳动合同”，不承担支付违法解除劳动合同责任。法律依据：《劳动合同法实施条例》第二十一条劳动者达到法定退休年龄的，劳动合同终止。
