劳动合同由单位和劳动者各保管一份，想要保险一点的还可以让劳动局存一份备案。劳动合同变订立或者变更后由用人单位和劳动者各执一份，用人单位不给劳动者的，劳动者可以向劳动行政部门举报。

法律客观：

中华人民共和国劳动法第二条在中华人民共和国境内的企业、个体经济组织(以下统称用人单位)和与之形成劳动关系的劳动者，适用本法。国家机关、事业组织、社会团体和与之建立劳动合同关系的劳动者，依照本法执行。
