释义	自首，是我国《刑法》中明确规定的一种有利的量刑情节。从《刑法》第67条的法条规定来看，我们可以看出，我国《刑法》要求认定自首必须满足两个要件，“自动投案”加“如实供述”，满足这两个要件便可以被依法认定为自首。《刑法》第67条规定：对于自首的犯罪分子，可以从轻或者减轻处罚。其中，犯罪较轻的，甚至可以免除处罚。被采取强制措施的犯罪嫌疑人、被告人和正在服刑的罪犯，如实供述公安机关、司法机关还未掌握的本人其他罪行的，也可以被认定为自首。
