劝酒者需要承担法律责任。一同喝酒的几个人之间,负有法律上的相互照顾义务。对于可能造成人身危害的行为,饮酒人之间应相互劝阻;对饮酒产生的一些行为不便,他人也应对其照顾、帮助。
法律依据:
《中华人民共和国民法典》 第一千一百七十三条 被侵权人对同一损害的发生或者扩大有过错的，可以减轻侵权人的责任。
