释义	脱逃罪是指依法被关押的罪犯、被告人、犯罪嫌疑人，从羁押和改造场所逃走的行为。行为人构成脱逃罪的，处五年以下有期徒刑或者拘役。本罪的主体是特殊主体，即必须是依照本法与刑事诉讼法被关押的罪犯、被告人、犯罪嫌疑人。法律依据《中华人民共和国刑法》第三百一十六条【脱逃罪】依法被关押的罪犯、被告人、犯罪嫌疑人脱逃的，处五年以下有期徒刑或者拘役。【劫夺被押解人员罪】劫夺押解途中的罪犯、被告人、犯罪嫌疑人的，处三年以上七年以下有期徒刑;情节严重的，处七年以上有期徒刑。
