释义	一般情况下，如果没有造成一定的后果。也就是说没有造成买受人的身体健康受损，是不会被处罚的，但如果侵害到买受人的身体健康，构成生产、销售劣药罪。法律依据:《中华人民共和国刑法》第一百四十二条规定，生产、销售劣药，对人体健康造成严重危害的，处三年以上十年以下有期徒刑，并处罚金；后果特别严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。药品使用单位的人员明知是劣药而提供给他人使用的，依照前款的规定处罚。
