释义	故意杀人案的坦白认定是如实供述自己罪行。坦白是指犯罪分子在司法机关询问、传讯或者采取强制措施后，对已被怀疑、发觉的犯罪事实供认交代的行为，应当从宽处罚。【法律依据】《中华人民共和国刑事诉讼法》第一百二十条第二款侦查人员在讯问犯罪嫌疑人的时候，应当告知犯罪嫌疑人享有的诉讼权利，如实供述自己罪行可以从宽处理和认罪认罚的法律规定。《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
