释义	人死了不是不用还钱了，如果有以下情况的，债务应当偿还：1、债务人死亡的，其遗产继承人应当以其继承的遗产为限为被继承人偿还债务2、没有遗产的，如果债务有保证人的，应当由保证人承担保证责任3、如果该债务属于夫妻共同债务的，债务人死亡后应当由其配偶承担债务4、如果没有以上情形的，债权债务消灭，不需要再还。法律依据: 《中华人民共和国民法典》第一千一百五十九条分割遗产，应当清偿被继承人依法应当缴纳的税款和债务；但是，应当为缺乏劳动能力又没有生活来源的继承人保留必要的遗产。
