释义	法律分析：由消协主持的调解是民间调解；由技术监督部门或工商部门主持的调解是行政调解，经营者拒不履行行政机关依法作出的行政调解意见，即行政处理决定，行政机关依法给予制裁。如果协商不成，消费者可以向人民法院起诉的。根据《消费者权益保护法》第34条规定，消费者与经营者发生争议可通过以下五种办法解决：（1）消费者与经营者协商和解；（2）请求消费者协会调解，当然这种调解是自愿的且调解协议不具有强制执行力；（3）向有关部门申诉；（4）提请仲裁机构仲裁；（5）向人民法院提起诉讼。
