释义	法律分析：只有以下两种情况，用人单位可与劳动者约定违约金： 1、用人单位对劳动者进行了专业技术培训，不是岗前职业培训，支付了培训费，可以在劳动合同或者培训协议中约定服务期，劳动者违反服务期约定的，应当向用人单位支付违约金。 2、劳动者违反竞业限制约定的，应当按照约定向用人单位支付违约金。用人单位违反上述规定，约定劳动者支付违约金的条款，违法无效。法律依据：《中华人民共和国劳动合同法》第二十三条劳动者违反竞业限制约定的，应当按照约定向用人单位支付违约金。
