释义	法律分析： 1、如果是产假，当然是三个月，按底薪算。计件按过去三个月的平均工资计算。 2、如果是病假，所有月薪工人以月薪为计算基准，所有计件工人则以其过去三个月的平均工资为计算基准。但工人所有之工资不低于最低工资的80%，如果低于此标准的，以最低工资的80%计发。法律依据：《中华人民共和国劳动合同法》第二十条劳动者在试用期的工资不得低于本单位相同岗位最低档工资或者劳动合同约定工资的百分之八十，并不得低于用人单位所在地的最低工资标准。
