倒卖文物罪是指倒卖国家禁止买卖的文物。所谓“国家禁止经营的文物”，是指受国家保护的并由国家有关主管部门核定公布的属于禁止经营的文物。本罪侵犯的客体是国家的文物管理制度。
【法律依据】：
《中华人民共和国刑法》第三百二十六条 以牟利为目的，倒卖国家禁止经营的文物，情节严重的，处五年以下有期徒刑或者拘役，并处罚金；情节特别严重的，处五年以上十年以下有期徒刑，并处罚金。
单位犯前款罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照前款的规定处罚。
