释义	法律分析：卖淫嫖娼不属于犯罪，我国法律上对卖淫嫖娼认定为行政违法，并不需要追究刑事责任，一般可以处行政拘留并处5000元以下罚款，但涉及到造成了其它的犯罪事实的，那么也是需要追究刑事责任的。法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
