释义	不管任何原因，跟踪别人都是违法行为，因为侵犯了别人的人身权利。但其情节比较轻微，若未造成任何严重的伤害，则可以不追究其责任，若造成了伤害，则要追究其责任。但是司法机关工作人员按照正当程序或者出于正当理由而跟踪的则不构成违法。法律依据：《中华人民共和国治安管理处罚法》第四条：在中华人民共和国领域内发生的违反治安管理行为，除法律有特别规定的以外，适用本法。在中华人民共和国船舶和航空器内发生的违反治安管理行为，除法律有特别规定的以外，适用本法。
