释义	法律分析：汽车买卖合同的行为属于是民事行为。该行为生效的具体要件是：其一、行为人具有相应的民事行为能力；其二、行为人买卖机动车的意思表示真实；其三、机动车买卖合同不违反法律或社会公共利益。法律依据：《中华人民共和国民法典》第四百八十三条承诺生效时合同成立，但是法律另有规定或者当事人另有约定的除外。第四百八十四条以通知方式作出的承诺，生效的时间适用本法第一百三十七条的规定。承诺不需要通知的，根据交易习惯或者要约的要求作出承诺的行为时生效。
