释义	法律分析：孩子16岁上班不算童工。我国法律上规定，未满十六周岁的用工为童工。法律依据：《禁止使用童工规定》第二条第一款国家机关、社会团体、企业事业单位、民办非企业单位或者个体工商户（以下统称用人单位）均不得招用不满16周岁的未成年人（招用不满16周岁的未成年人，以下统称使用童工）。《中华人民共和国劳动法》第五十八条第二款未成年工是指年满十六周岁未满十八周岁的劳动者。
