释义	驱逐出境，指对在中国境内犯罪的外国人或无国籍人，强制其离开中国境内的刑罚。由人民法院判决并执行。可独立适用，亦可附加适用，附加适用应存主刑期满后执行。驱除出境的适用有十分严格的规定，他不仅要考虑犯罪情节、罪行轻重，还要考虑国际大形势、犯罪人国籍国与我国的外交关系，如果单纯的从刑事处罚考虑，可能会给我国的外交工作带来一定的难度。法律依据：《中华人民共和国刑法》第三十五条对于犯罪的外国人，可以独立适用或者附加适用驱逐出境。
