通报批评是属于行政处罚处分。通报批评具备行政处罚构成的基本要件。行政处罚是国家特定行政机关依法惩戒违反行政法律规范的个人、组织的一种行政行为，它具有行政性、处分性、制裁性。而通报批评是由行政主体针对具体的当事人作出，是其行政职权运行的体现，具备行政性。《中华人民共和国行政处罚法》第七条公民、法人或者其他组织因违法受到行政处罚，其违法行为对他人造成损害的，应当依法承担民事责任。违法行为构成犯罪，应当依法追究刑事责任，不得以行政处罚代替刑事处罚。
