释义	法律分析：不一样。基本工资和固定工资都不是法律术语，一般而言应该区别不大，但从法院审判而言，一般是写基本工资较多，基本工资一般是法律上的标准工资或者正常时间工资。这样的约定只要是为了减少加班工资支付以及经济补偿金等工资的支付，一般而言对劳动者不利。法律依据：《中华人民共和国劳动法》第四十六条工资分配应当遵循按劳分配原则，实行同工同酬。工资水平在经济发展的基础上逐步提高。国家对工资总量实行宏观调控。
