释义	无力偿还并不等于不想偿还，所以不算恶意透支。恶意透支，是指持卡人以非法占有为目的，超过规定期限或者期限透支，经开证行两次催促超过3个月仍未归还的。恶意透支通常只针对逾期的信用卡。如果是贷款，就没有恶意透支，因为只有信用卡才有透支功能。为了证明自己是无力偿还而不是恶意透支，在信用卡逾期后，如果确实资不抵债。可以去街道办事处、居委会或村委会。开具困难证，也称为贫困证，然后加盖居委会或村委会公章。除了贫困证明，持卡人还可以用疾病案例、失业证明等来证明自己确实无法偿还，而不是恶意透支。
