释义	实践中，杀害被绑架人的有三种情形：1、是在绑架过程中因遭到被害人的反抗而杀死被绑架人。2、是绑架行为实施后勒索财物或提出其他不法要求之前杀害被绑架人。3、是因勒索不成或非法要求得不到满足而杀害被绑架人。行为人在绑架中杀害被绑架人的，适用绑架罪的加重法定刑处罚，而不能以绑架罪和故意杀人罪实行数罪并罚。根据《刑法》第二百三十九条第二款规定：犯绑架罪，致使被绑架人死亡或者杀害被绑架人的，处死刑并处没收财产。法律依据《中华人民共和国刑法》第二百三十九条
