释义	法律分析：劳动教养，是对那些有违法行为，但情节轻微、可以不追究刑事责任的人，经过劳动教养机关的审查批准，由司法机关收容，通过有偿劳动，对他们实行强制性的教育和改造。劳教的时间为 1 年到3 年，必要时可以延长 1年。劳动改造，是根据我国刑法的规定，由劳改机关对被人民法院判刑的犯罪分子执行的一种刑罚。法律依据：《中华人民共和国刑法》第四十六条被判处有期徒刑、无期徒刑的犯罪分子，在监狱或其它执行场所执行，凡有劳动能力的，都应参加劳动，接受教育和改造。
