释义	法律分析：只要与用人单位建立劳动关系，都属于正式工，受法律保护。用人单位自用工之日起即与劳动者建立劳动关系。应当自用工之日起一个月内与劳动者订立劳动合同。双方的权利义务，由劳动合同进行约定。按现行法律规定已无临时工和正式工之分，都要签订劳动合同，连续工作十年以上可要求订立无固定期限劳动合同。法律依据：《中华人民共和国劳动合同法》第七条用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
