释义	法律主观：在办理房产过户手续时，当事人必须提供房产证、土地证和契税证，否则无法过户。如果办理不了过户手续，那买方也无法落户。只有房产证没有土地使用权证，势必会给住宅地产购置及交易带来以下风险： 1、难以知晓在土地使用权上设定抵押权的情况，也就无法及时规避风险。 2、难以发现开发商违规用地的事实。 3、二手房交易将受影响。《城市房地产管理法》规定，房地产上市交易，必须出示房屋所有权证和国有土地使用权证。 4、在拆迁补偿时会遭受损失。《城市房屋拆迁估价指导意见》第三条规定，房屋拆迁评估价格为拆迁房屋的房地产市场价格。因此，拆迁补偿金不仅包含房屋所有权价值，还包含了土地使用权价值。 5、购房者如果未办理土地使用权证，在拆迁过程中就可能得不到关于土地使用权的相应补偿。 6、办理房屋抵押贷款时如果没有土地证，一部分银行是可以办理的，但另一部分银行是必须房产证、土地证两证齐全才能办房屋抵押贷款。
