释义	双方当事人约定的利率超过合同成立时一年期贷款市场报价利率一倍之外的部分，不受到法律的保护，可以不支付。但属于一倍以内的部分受到法律的保护，需要支付。法律依据《中华人民共和国民法典》第六百八十条，禁止高利放贷，借款的利率不得违反国家有关规定。借款合同对支付利息没有约定的，视为没有利息。
