释义

法律主观：

当事人捡到钱不还的，如果数额较大则犯法。当事人拾得遗失物，应当返还权利人。将他人的遗忘物非法占为己有，数额较大，拒不交出的，构成侵占罪，可以处二年以下有期徒刑、拘役或者罚金。

法律客观：

《民法典》第三百一十四条规定，拾得遗失物，应当返还权利人。拾得人应当及时通知权利人领取，或者送交公安等有关部门。
