释义	法律分析： “一般情况下，公司向员工集资是合法的。具体来说，如果依法签订了借款合同，并具有正当目的，是用于公司生产经营的，那么该行为合法。反之，则可能构成非法吸收公众存款或者变相吸收公众存款罪。” 法律依据：《最高人民法院关于审理民间借贷案件适用法律若干问题的规定》第十二条法人或者其他组织在本单位内部通过借款形式向职工筹集资金，用于本单位生产、经营，且不存在合同法第五十二条、本规定第十四条规定的情形，当事人主张民间借贷合同有效的，人民法院应予支持。
