法律分析：不违法。中国的职业年金是一种补充养老保障制度，既不是社会保险，也不是商业保险，而是一项单位福利制度，是事业单位及其职工依据自身经济状况建立的保障制度，事业单位及其职工承担因实施职业年金计划所产生的所有风险。
法律依据：《机关事业单位职业年金办法》 第三十二条 职业年金所需费用由单位和工作人员个人共同承担。单位缴纳职业年金费用的比例为本单位工资总额的8，个人缴费比例为本人缴费工资的4，由单位代扣。单位和个人缴费基数与机关事业单位工作人员基本养老保险缴费基数一致。
