释义	法律分析：劳动者不能胜任工作，从横向比较的角度，既指劳动者不能按照用人单位的规定或者要求完成劳动合同中约定的工作任务，又指劳动者不能达到同样工作经历、同样工种、同样工作岗位、同样工作技能等的劳动者完成工作任务的水平。法律依据：《中华人民共和国劳动法》第四十条用人单位要以不能胜任工作解除劳动合同，必须满足三个条件：(1)劳动者不胜任本职工作;(2)对劳动者进行了重新培训或调岗;(3)重新培训后仍不能胜任原工作或者调整岗位后不能胜任新岗位。
