释义	离职经济补偿金超过当地上年职工平均工资3倍数额的部分，才要按照个人所得税纳税。即使纳税，还要除以个人在本企业的工作年限数。劳动者与用人单位解除或者终止劳动合同时，依法应当获得的经济补偿金属于员工离职后的一次性经济补偿收入，按照目前的个人所得税纳税范围，是应当按照“工资、薪金所得”项目计征个人所得税。但这并不是说，员工的离职经济补偿金都要缴纳个人所得税。只有那些离职经济补偿金超过当地上年职工平均工资3倍数额的部分，才要按照个人所得税纳税。
