释义	法律分析：用人单位与劳动者解除劳动关系时，除法定情形外，应当给予一定的劳动经济补偿，但是聘用单位与返聘人员解除关系时，则不享有此经济赔偿。退休的员工不再属于劳动部门管理，不能签订正式的劳动合同，所以不能依据我国《劳动法》第二十八条执行。发生争议的，若属于劳动争议仲裁委员会受案范围的，其应予受理。法律依据：《中华人民共和国劳动法》第二十八条用人单位依据本法第二十四条、第二十六条、第二十七条的规定解除劳动合同的，应当依照国家有关规定给予经济补偿。
