释义	律师分析: 在诉讼的时候，如果说诉讼关系到第三人的利益，而在诉讼的时候并没有第三人的参与的话第三人有一个救济的权利就是直接提起第三人的撤销之诉。法律依据: 《中国人民诉讼法》第二百九十二条第三人知道或者应当知道其民事权益受到损害之日起6个月内可提起撤销之诉。在实务中应注意两点，一是何谓“知道或应当知道”?认定时需考虑到第三人与案件当事人之间关系、执行时是否涉及第三人等客观条件并结合法官的自由心证综合判断。该六个月期间，属于除斥期间，不适用诉讼时效延长、中止、中断的规定。
