释义	法律分析：私开补习班是违法的。教育局明确规定，在职教师不能在假期私自对学生补课，也就是说不能暑假办补习班。开办个人补习班必须到当地教育行政部门申请办学许可证，补习班的授课教师需要有教师资格证，这样才是合法的。当然如果规模不大，可以视为民事合同关系也是合法的。法律依据：《中华人民共和国教育法》第七十五条违反国家有关规定，举办学校或者其他教育机构的，由教育行政部门或者其他有关行政部门予以撤销；有违法所得的，没收违法所得；对直接负责的主管人员和其他直接责任人员，依法给予处分。
