释义	法律分析：员工离职公司时，公司应该依法支付其目前为止应得的劳动报酬。如果用人单位不发工资的，劳动者可以采取以下方式维护自己的合法权利：1、向相关负责人提出异议，与其自由协商；2、向劳动行政部门投诉；3、进行调解或者仲裁；4、提出诉讼。法律依据：《工资支付暂行规定》第七条工资必须在用人单位与劳动者约定的日期支付。如遇节假日或休息日，则应提前在最近的工作日支付。工资至少每月支付一次，实行周、日、小时工资制的可按周、日、小时支付工资”的规定，超过一个月没发工资，就应视为拖欠工资。
