法律分析：
不算，强奸是指违背妇女意志，使用暴力、胁迫或者其他手段，强行与妇女发生性交的行为，或者故意与不满14周岁的幼女发生性关系的行为。根据法律中的规定，与不满十四周岁的幼女发生性关系者，无论幼女自愿与否均构成犯罪。
法律依据：
《中华人民共和国刑法》第二百三十六条 奸淫不满十四周岁的幼女的，以强奸论，从重处罚。
