释义	法律分析：定金合同属于从合同，目的在于担保主合同义务的履行，其效力附属于主合同的效力，主合同未生效的，定金合同亦不能发生效力。因此主合同未成立的，因不能归责于双方的原因导致主合同未成立的，不适用定金罚则，收受定金一方应当退还定金。法律依据：《中华人民共和国民法典》第六百八十二条保证合同是主债权债务合同的从合同。主债权债务合同无效的，保证合同无效，但是法律另有规定的除外。保证合同被确认无效后，债务人、保证人、债权人有过错的，应当根据其过错各自承担相应的民事责任。
