释义	法律分析：以侵害他人合法权益或者违反法律禁止性规定的方法取得的证据，不能作为评定案件事实的依据。为了取得证据，而侵入第三住宅，是侵权行为，当然取得的证据不具备合法性。但如果在自己家取证，不存在此种问题。在宾馆通过监控录像拍摄的、破门而入在他人家中拍摄的都不能作为证据使用法律依据：《中华人民共和国刑事诉讼法》第四十三条审判人员、检察人员、侦查人员必须依照法定程序收集能够证实犯罪嫌疑人有罪或无罪、犯罪情节轻重的各种证据。严禁刑讯逼供和以威胁、引诱、欺骗以及其他非法的方法收集证据。
