释义	法律分析：狭义的抗辩与抗辩权的区别有二：(1)功能不同。抗辩权的功能在于虽认可对方的请求权存在但阻碍请求权的行使；狭义的抗辩的功能则在全部或部分否认对方的请求权存在。(2)是否主张不同。在诉讼中，法院可以不待当事人主张依职权主动适用狭义的抗辩；但抗辩权必须由抗辩权人主张，法院不得依职权主动适用。法律依据：《中华人民共和国民法典》第七百零一条保证人可以主张债务人对债权人的抗辩。债务人放弃抗辩的，保证人仍有权向债权人主张抗辩。
