释义	挂靠别人公司税务由被挂靠的公司缴纳，发票抵扣是需要发生业务时，开成挂靠公司抬头的增值税专用发票才能抵扣。需要说明的是挂靠不合法。《建筑法》已对挂靠行为作出了禁止性规定。法律依据：《中华人民共和国税收征收管理法》第三十六条企业或者外国企业在中国境内设立的从事生产、经营的机构、场所与其关联企业之间的业务往来，应当按照独立企业之间的业务往来收取或者支付价款、费用;不按照独立企业之间的业务往来收取或者支付价款、费用，而减少其应纳税的收入或者所得额的，税务机关有权进行合理调整。
