释义	根据我国法律的规定，夫妻离婚只能通过协议离婚和诉讼离婚进行，不存在自动离婚一说。也就是说，离婚必须通过向民政局登记离婚或者向法院起诉离婚的方式进行。夫妻的婚姻关系必须经过民政局登记领证才能缔结，同居不能导致双方拥有合法的夫妻关系。与结婚一样，离婚也必须按照法律规定的程序办理，要么向民政局登记离婚，要么向法院起诉离婚，分居并不能导致夫妻自动离婚，分居多久都不可以自动离婚。法律依据关于人民法院审理未办结婚登记而以夫妻名义同居生活案件的若干意见
